Was PTI abused?
To know the correct answer, first review the facts
As per the Election Act 2017 every political party is required to submit Form 46 certificate to ECP regarding the intra-party election of the political party. If not, ECP can take action against the political party.
According to the PTI constitution, elections were to be held every three years.
Due to Corona, ECP has given one year time to PTI to hold intra-party elections till June 13, 2022.
PTI told ECP that it has called intra-party elections on June 10, 2022; The date of which could not be confirmed by PTI. This election was also under serious allegations from the insiders of the party that they were not transparent and they were not given a chance to fight.
The ECP once again gave PTI time to re-run the election within 20 days. Although the ECP had the power to withdraw the electoral symbol from the PTI only then, the PTI was still given a reprieve. This is the answer to the objection that why soft attitude towards ANP and tough attitude towards PTI. PTI was also given respite by respite and respite of years, months, days by ECP to conduct fair and transparent elections and did not take away the election symbol on the first occasion.
But this could not happen and on 2nd December 2023, another Jharlo election was held in Chamkani, a suburb of Peshawar, which became a challenge once again.
One aspect of this matter is also from the past that PTI told ECP on May 1, 2019 that elections were held in 2017 in which Imran Khan was elected as Chairman, Shah Mehmood Qureshi as Vice Chairman and Jahangir Tareen as Secretary General. But suddenly in 2018/19 the Chairman removes the Secretary General and Asad Umar becomes the Secretary General. Regarding the intra-party election on June 10, 2022, the ECP is informed that Asad Umar has been elected as the Secretary General, while the election was declared null and void by the ECP.
In the 2022 election itself, PTI wrote to the ECP and told that Jamal Akbar Ansari is its Chief Election Commissioner (CEC term is 5 years as per PTI constitution). appointed Chief Election Commissioner. The appointment of Niazullah Sahib was also wrongly done by a mere notification of Umar Ayub Khan. Umar Ayub Khan's own position, as Secretary General, was controversial before the ECP as he too was not constitutionally elected by any PTI body or forum. Moreover, according to the PTI constitution, the intra-party elections have to be conducted by the Federal Election Commission and not by the single Chief Election Commissioner. Niazullah Niazi, who conducted the flash election on 2 December 2023, wrongly appointed Secretary General Umar Ayub Khan, who himself was not constitutionally the Secretary General of PTI as he represented the PTI before the ECP. According to the records kept, Asad Umar was Secretary General and PTI could not provide any record of Umar Ayub's election. Imran Khan's tenure as Chairman had also ended on June 13, 2023, and after the end of this term, Imran Khan was also not authorized to appoint any official or extend his tenure as per the PTI constitution. .
